WORCESTER DISTRICT COURT CONCILIATION PANEL
The WCBA’s Worcester District Court Conciliation Panel is looking for new members who are willing to volunteer an hour every two months to assist the District Court in conciliating civil cases on the day they are scheduled for trial. If you have trial experience and would be willing to volunteer some time to assist the court and the litigants in trying to resolve civil cases prior to trial, please send an email to Bill Hays at whays@chwmlaw.com and he will contact you with the details.

STATEMENT ON BOSTON GLOBE SPOTLIGHT SERIES
The WCBA strongly disagrees with the message conveyed in the recent Globe Spotlight series focusing on the Massachusetts judiciary. The WCBA has always supported access to justice to our citizens as well as upholding an impartial judicial system. An oft-quoted passage in the Massachusetts Constitution declares that “It is the right of every citizen to be tried by judges as free, impartial and independent as the lot humanity will admit.”
The judges of the Commonwealth are comprised of men and women of the utmost integrity, dedication and intellect who strive on a daily basis to perform their duties conscientiously and honorably. In particular the Worcester County judiciary is among the finest and most ethical members in the Commonwealth. We recognize that the Boston Globe attempted to shed light on the drunken driving laws in the Commonwealth. However, the attacks on our judiciary were an inaccurate depiction of how OUI cases are handled. The WCBA supports our Commonwealth judges and the excellent job that they continue to do in administering justice.
NOTICE FROM PAULA M. CAREY,
CHIEF JUSTICE PROBATE AND FAMILY COURT
As many of you know the Probate and Family Court is expected to lose 20% of our bench by the beginning of January, 2013. We have lost 8 judges to date and have received no appointments for any of the judges recently retired. This shortage has caused my office to employee the services of a recall judge (Judge Joseph Lian, Jr.) and to reallocate judges to other counties in order to ensure that we can meet the needs of the entire system in the best way that we can. As part of this reallocation, Judge Gregory Roach will be temporarily transferred to Norfolk County Probate and Family Court effective January 3, 2013. I expect this transfer to be short term. Thank you for your patience.
NOTICE FROM THE WCBA INSURANCE COMMITTEE
The Insurance Committee wishes to notify the membership of the following significant favorable changes which are being made to the dental insurance and disability income protection programs available to members of the Worcester County Bar Association:
DENTAL INSURANCE – The Bar Association has endorsed Altus Dental, based in Providence, Rhode Island, as the exclusive provider of dental insurance for WCBA members, their families and employees. Altus Dental has put together a custom-made plan for the Bar Association with very favorable premiums. Altus is prepared to guarantee these premiums for two years provided that a sufficiently large number of eligible association members/family members/employees subscribe to coverage. The Altus Dental proposal also features a $1,500.00 annual per-person payout cap, representing an increased cap of some 25% to 50% above most other available dental insurance plans.
DIABILITY INCOME PROTECTION INSURANCE Guardian Life Insurance Company has been endorsed as the exclusive provider of Disability Income Protection, replacing MassMutual Insurance Company as the Bar Association’s exclusive provider. The Guardian offers superior contract provisions for professionals such as attorneys at more competitive premium rates. Additionally, The Guardian offers a 10% premium discount to WCBA members on policies issued during the first year of this program. For policies written in subsequent years, this 10% discount may or may not be continued, depending upon the number of policies written during the first year; however, for policies written in the first year, that 10% discount will continue to apply for the duration of the policies’ effective life. The Insurance Committee is aware that many members of the association currently maintain disability coverage through MassMutual and/or The Paul Revere/UNUM. The committee would not recommend that any members so covered change their coverage to The Guardian without first making very sure that the benefits and premiums locked in under those previously issued policies are not more favorable (in light of age and health factors) than those which could be obtained presently through The Guardian.

WCBA REDUCED FEE PROGRAM NEEDS PANEL ATTORNEYS
The Reduced Fee Program of the Worcester County Bar Association is looking for attorneys to serve on its panel of attorneys willing to represent marginally indigent clients at a reduced rate. Through the Reduced Fee Program, attorneys agree to charge no more than $75.00 per hour to the client. To receive information on the program, please contact Candice Staples at 508-752-1311.
